General Terms and Conditions (GTC) of Puricura (Medara GmbH)
1. Scope
These General Terms and Conditions (GTC) apply to all orders and deliveries between Puricura (hereinafter referred to as "Seller") and its customers (hereinafter referred to as "Customer").
2. Conclusion of Contract
The contract is concluded through the customer's order and the seller's order confirmation. The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to order.
3. Prices and Shipping Costs
All prices are stated in Swiss Francs (CHF) and include the statutory value-added tax. Shipping costs are charged additionally and will be displayed to the customer before placing the order.
4. Payment Terms
The customer has the option to choose from the payment methods offered in the online shop. Payment is due immediately unless otherwise agreed.
5. Delivery and Delivery Conditions
Delivery will be made to the address provided by the customer. Delivery times are non-binding unless a binding delivery date has been expressly promised. If a ordered product is not available, the customer will be informed immediately.
6. Right of Withdrawal
The customer has the right to withdraw from the contract within 14 days without giving any reasons. The withdrawal period is 14 days from the day the customer or a third party designated by him takes possession of the goods. To exercise the right of withdrawal, the customer must inform the seller of his decision by means of a clear statement (e.g., a letter sent by post or email). To meet the withdrawal deadline, it is sufficient for the customer to send the notification of the exercise of the right of withdrawal before the withdrawal period expires.
7. Warranty and Liability
The seller is liable for defects in the delivered goods according to the statutory provisions. Further claims of the customer, in particular claims for damages, are excluded unless they are based on intent or gross negligence of the seller.
8. Data Protection
The processing of personal data is carried out in accordance with the applicable data protection laws. Further information can be found in the seller's privacy policy.
9. Applicable Law and Jurisdiction
Swiss law applies, excluding the UN Sales Convention (CISG). The place of jurisdiction is the seller's registered office, provided the customer is a merchant, a legal entity under public law, or a special fund under public law.
10. Final Provisions
Should individual provisions of these GTC be or become ineffective, the validity of the remaining provisions shall remain unaffected. Instead of the ineffective provision, a legally effective provision that corresponds to the purpose of the regulation shall apply. Amendments and additions to these GTC require written form.
